GUEST IDENTIFICATION:
Guests must book reservations under the exact full name as stated on their government-issued travel documents. Any name changes after travel documents have been issued will incur name change fees, if applicable, for which clients will be responsible.
PAYMENTS:
Reservations can only be made using major credit cards and debit cards.
PAYMENT PLANS:
Upon signing the payment agreement, payment plans become binding agreements, and you are contractually obliged to make payments on the specified due dates as outlined in the agreement.
REFUND POLICY:
The policy of non-refundable and non-transferable payments to Simplistic Journeys is enforced due to contractual obligations with our partners such as hotels, airlines, and other vendors. This policy allows us to offer competitive package prices and convenient monthly payment options for your vacation.
PASSPORTS AND VISAS:
Passengers are responsible for ensuring they possess the necessary travel documents and should consult the relevant consulate(s) or visa agency to ascertain any visa or passport requirements. Passports must remain valid for at least six months beyond the travel date, and some countries may necessitate a full blank "VISA" page in the passport for stamping purposes. Information provided regarding travel descriptions is applicable to US citizens only; non-US citizens should consult the respective consulate(s) of the country(s) they plan to visit for current entry requirements. We highly recommend all cruise passengers have a valid passport while cruising.
TRAVEL INSURANCE:
Obtaining Travel Insurance is strongly advised as it offers vital coverage for unexpected situations like Trip Cancellation, Interruption, Baggage Loss or Delay, and Medical Expenses. It's crucial to personally select and purchase travel insurance for domestic, Caribbean, and international tours to protect your investment and ensure peace of mind during your trip.
TRAVEL DOCUMENTS:
Upon receiving full payment by your Final Payment Due date, travel documents and instructions will be dispatched via email and/or mail at least 30 days prior to your travel date. If paper documents are preferred despite e-documents being available, they will be sent via USPS approximately 14-21 days before departure, incurring a $60 fee. Kindly provide a complete street address (No P.O. Boxes) for delivery.
CHILDREN:
All children under 18 must be accompanied by an adult. The minimum age requirement for most tours is 6 months, except for South Africa and Dubai Tours, which have a minimum age of 12. European Tour programs also have a minimum age requirement of 12. For cruise tours, children must be at least 6 months old and share a cabin with an adult over the age of 25. Some resorts on Caribbean and Mexico Tours offer discounts for children under 12 sharing a room as a third person. Accompanying adults are responsible for ensuring the safety of their children, including providing necessary safety equipment like infant/child seats where applicable. Additionally, please be aware that many countries have adopted measures to prevent international child abductions. If a person under 18 will be traveling with an adult other than their parents or with only one parent, a notarized letter from the parents or non-traveling parent granting authorization for travel, including travel dates, should be carried.
PRICE RATES:
All price rates indicated are per person and based on double occupancy of a twin room, unless otherwise stated. Prices exclude personal expenses such as laundry, alcoholic beverages, food (except at all-inclusive resorts or as explicitly stated), passport and visa fees, insurance, and foreign port taxes unless expressly included in the package. While every effort is made to ensure accuracy at the time of publication, tour package prices and availability are subject to change due to fluctuating airfares and limited capacity in certain service classes. In the event of a human or computer error, Simplistic Journeys, LLC reserves the right to correct the price or service and provide a full refund to passengers who choose not to accept the revised terms, provided a written cancellation is received within five days of notification of the price adjustment.
PAYMENTS & CANCELLATION:
Deposit: A non-refundable and non-transferable deposit is required upon reservation, with the specific amount clearly outlined. All reservations, unless otherwise stated, necessitate a deposit, along with details of the amount due and any applicable monthly payment plan.
Full Payment: Reservations can be paid in full at the time of booking, subject to availability.
Late Payment: Failure to settle outstanding balances by the Final Payment Due date specified on your invoice will result in an automatic late fee being applied the day after the final payment deadline. Late fees vary; please refer to individual tour descriptions for details.
REINSTATEMENT OF RESERVATIONS:
In the event of cancellation, should you decide to reinstate your travel reservations within 14 days, a reinstatement fee per guest will be applied. This fee, which is $150 for domestic tours and $300 for international tours, is charged in advance to ensure the reconfirmation of your services.
LAST MINUTE RESERVATIONS:
To ensure a smooth travel experience, it's crucial to make reservations at least 45 days before your departure date. If the requested services cannot be confirmed, you will receive a refund for your payment. However, for confirmed services, final payment is required within 24 hours. After this period, cancellation penalties may apply, emphasizing the importance of timely booking and payment completion.
PAYMENT METHOD:
We accept major credit cards or debit cards for payment. All payments must be completed within 60 days of departure unless otherwise specified, and payments must be made exclusively by credit or debit card. Credit card transactions can be made over the phone or online to fulfill the non-refundable deposit requirement.
REFUNDS:
If you have purchased Travel Protection Plus Cash Refund through Simplistic Journeys, LLC, refunds will be issued to the credit card(s) originally used for payment, up to the total amount paid minus the cost of the travel protection plan.
If you have purchased Travel Protection Plus Full Travel Credit through Simplistic Journeys, LLC, refunds will be provided in the form of a travel credit, up to the total amount paid minus the cost of the travel protection plan.
If you have not purchased a Travel Protection Plan through Simplistic Journeys, LLC and need to cancel, all previous payments are forfeited.
Upon reaching the final payment date, if a refund is requested, a cancellation fee will be incurred from the vendor and Simplistic Journeys, LLC. This is because after the final payment date, your reservation and accommodations are confirmed.
CANCELLATION POLICY:
After making reservations, cancellations will only be accepted in writing. Please email your cancellation request to info@simplisticjourneys.com , including your invoice number, full name, and travel date. If you do not receive an acknowledgment within 48 hours, please call 1-813-733-9570 to ensure your information was received. Simplistic Journeys reserves the right to charge a cancellation fee to the card on file. This fee will be equivalent to the commission that was due to the agency, ranging from the minimum to the maximum amount of the commission payout from the vendor or suppliers.
RESERVATION CHANGES:
Any changes to an existing reservation, regardless of the reason, will incur a fee of $75 per person, For Domestic tours and $150 for international tours in addition to any supplier fees. This fee covers modifications such as name changes and removal of optional services like tours and transfers. Please note that name changes on airline reservations may necessitate full cancellation and rebooking. Additionally, substituting one traveling passenger with another constitutes a cancellation, subject to penalties, and is not covered by this Reservation Change policy. Changes or additions made after departure will be subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. Unused services are non-refundable.
FORCE MAJEURE
There may be occasions when either party is unable to fulfill or complete performance under the travel contract due to circumstances beyond their control. These are known as force majeure events and may render performance under the contract inadvisable, commercially impracticable, illegal, or impossible. Such events may include, but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military actions, strikes or labor disturbances, criminal or terrorist activities, pandemics, epidemics, illnesses or health conditions prevalent in the travel area, natural disasters such as earthquakes, hurricanes, lightning, and explosions, unforeseen legislation, or any other event beyond the reasonable control of either party. In the event of a force majeure event, the parties will adhere to the cancellation policies outlined by the suppliers, as well as those specified in the travel proposal and these terms & conditions. Any alterations to these policies are at the discretion of the supplier (if applicable) and the Travel Agency. Passengers will be informed of their options should a force majeure event occur.
TRAVELERS WITH DISABILITIES
To ensure a fulfilling experience on your Simplistic Journeys, LLC tour, we recommend selecting a trip suitable for your physical capabilities. Travelers requiring assistance, including those with physical disabilities, sight, or hearing impairments, must notify Simplistic Journeys, LLC prior to booking for assessment and approval. Additionally, such travelers must be accompanied by an individual responsible for helping, as our tour staff are unable to fulfill this role. Participation in escorted tours requires the ability to understand and follow instructions provided by the Tour Director for both tour operation and personal safety.
Simplistic Journeys, LLC reserves the right to refuse participation or remove any individual from a tour if notification was not provided and if continued participation would significantly impact services provided to other guests. Expenses resulting from removal, including cancellation fees or alternative travel arrangements, are the responsibility of the passenger.
Escorted tours often involve brisk activity, including extended walks over uneven terrain. To ensure group harmony, participants should maintain the pace of the tour. Clients with special needs may find independent touring more suitable, and Simplistic Journeys, LLC can recommend options tailored to specific requirements.
Wheelchairs & Walkers:
USA Tours: Simplistic Journeys, LLC aims to accommodate disabled travelers in accordance with the Americans with Disabilities Act (ADA) and tour itineraries. However, some tour features may not be fully accessible to travelers requiring wheelchairs, scooters, or other specialized equipment. Individual assistance with mobility devices is not provided, and certain itineraries may not accommodate such devices. Passengers must notify Simplistic Journeys, LLC of accessibility requirements before booking, allowing for determination of reasonable accommodations.
International Tours: Accommodations for disabled passengers may vary outside the United States, as ADA requirements do not apply. Some venues may lack facilities such as ramps or elevators, limiting accessibility for wheelchairs, walkers, or scooters. Due to space constraints, mobility devices may not be permitted on motor coaches or river cruises.
Service Animals: Service animals are not accommodated on international escorted tours. Passengers requiring a service dog on USA tours should consult Simplistic Journeys, LLC before booking for guidance.
AIRLINES:
Simplistic Journeys, LLC emphasizes that airlines operate independently, and their services and policies are beyond our control. Flight schedules are subject to change without notice, and passengers may incur penalties for tickets not issued by Simplistic Journeys, LLC due to such changes. When making airline reservations online, we reserve the right to review and potentially rebook flights to align with minimum connecting times or tour package itineraries. This may require immediate payment of airfare, overriding invoice terms and conditions.
Once full payment is received, Simplistic Journeys, LLC issues airline tickets, which become fully non-refundable. In some cases, earlier ticket issuance may necessitate a larger non-refundable deposit or full payment.
Airline seat assignments are at the discretion of the airlines, particularly for group flights. Our contracts typically cover economy class seats, and passengers seeking other classes of service may consider purchasing flights separately and booking land-only packages through Simplistic Journeys, LLC.
For frequent flyer programs, passengers should liaise directly with their airlines regarding mileage eligibility and accrual. Airline policies vary, and some fares or flights may not be eligible for mileage accrual. While we record frequent flyer numbers provided by passengers, eligibility for mileage accrual ultimately lies with each airline.
In compliance with TSA Secure Flight requirements, passengers must provide accurate personal information to Simplistic Journeys, LLC, including full names as per government-issued identification, date of birth, gender, contact details, and address. Incorrect information may result in boarding issues or failure to receive essential documents.
Given the complexities involved, passengers are encouraged to take proactive measures, such as providing frequent flyer details during check-in and verifying eligibility for mileage credit before travel commences. Simplistic Journeys, LLC is committed to facilitating smooth air travel experiences but cannot be held responsible for issues arising from inaccurate information or airline policies beyond our control.
Airline Schedule Changes:
In the event of an airline schedule change, Simplistic Journeys, LLC endeavors to notify passengers promptly of the revised flight schedule before departure. However, we cannot be held responsible for schedule alterations, including changes in routing or the number of stops in the itinerary. Simplistic Journeys, LLC is unable to provide compensation for such changes, seat assignment modifications, or cancellations initiated by the airline. If passengers make any flight itinerary changes directly with the airline, it is their responsibility to inform Simplistic Journeys, LLC in writing at info@simplisticjourneys.com . Please note that if flights are altered without our knowledge, we cannot guarantee land services, including arrival and departure transfers.
Airline Name Changes:
It's crucial to note that any alteration to passenger names, even minor spelling corrections, may necessitate the cancellation and rebooking of airline reservations. Such changes are contingent upon current availability and pricing at the time of rebooking. Once airline tickets have been issued, any subsequent name corrections will typically incur an airline rebooking fee, which could amount to the full value of the ticket plus a $50 revision fee per change. Simplistic Journeys, LLC cannot be held liable for any denial of services by the carrier due to discrepancies in passenger names. Therefore, all name-change requests must be communicated in writing to info@simplisticjourneys.com .
Airline Taxes & Fuel Surcharges:
If you've purchased airfare through Simplistic Journeys, LLC, airline taxes and fuel surcharges are already included in the fare. However, it's important to be aware that prior to completing full payment, there's a possibility of price increases due to government-levied taxes, fees, and fuel surcharges. To mitigate this risk, you may opt to accelerate your final payment to expedite ticket issuance. Once tickets are issued, they are no longer susceptible to potential increases but become fully non-refundable. Additionally, certain overseas domestic flights may entail local air taxes, as outlined in our package presentations and pre-departure documentation.
Luggage (Airlines):
When traveling by air, checked bags are typically restricted to a total dimension of 62 inches (length + width + height) and a maximum weight of 50 lbs. (23 kg). Many airlines impose fees for checked bags, excess luggage, or overweight items. Simplistic Journeys, LLC bears no responsibility for these charges. In case of loss or damage to luggage by the airline, passengers must file a baggage claim form with the carrier before leaving the airport. We advise using distinct identifiers like brightly colored tags or straps to aid in identifying or describing luggage.
Luggage (Escorted Tours):
On Simplistic Journeys, LLC escorted tours, each traveler is allowed one piece of luggage and a carry-on bag. Additional baggage incurs a handling charge of $100 per piece. Please note that Simplistic Journeys, LLC assumes no liability for loss or damage to luggage or personal belongings. Any incidents must be reported immediately to local authorities, and a written report obtained for submission to your insurance provider.
HOTEL ACCOMMODATIONS:
When arranging hotel accommodations, it's essential to note certain considerations to ensure a comfortable stay. While we strive to fulfill specific requests such as bed type preferences, it's important to understand that these requests are subject to availability and ultimately determined by the hotel's management. Triple and quad occupancy rooms on cruises typically feature two beds, with each person assigned a twin bed. Please be aware that some single rooms may be smaller than standard rooms, and the number of occupants does not dictate room size.
Moreover, it's crucial to acknowledge that air conditioning standards abroad may differ from those in the United States, particularly in older European hotels where central air conditioning may not be always available or operational. Additionally, hotel rates are based on agreements between Simplistic Journeys, LLC and its suppliers and are non-negotiable.
Check-in and check-out times typically adhere to industry standards, with check-in usually after 3:00 p.m. and check-out prior to noon. When planning accommodations for late-night flights, it's advisable to consider the need for adequate arrangements, especially if a day room is included in the itinerary, with check-out typically set for a specified time.
While Simplistic Journeys, LLC strives to provide accurate hotel and cruise ship profiles based on information received from partners and representatives, it's important to note that star ratings may vary by country. Despite our efforts to maintain up-to-date information, we cannot guarantee the accuracy of descriptions, amenities, or images provided by third parties. Therefore, we reserve the right to substitute hotels of equal standard if necessary, and refunds will not be issued for any differences in accommodation costs.
MEALS:
Meals provided during your journey are outlined in each itinerary and are typically served according to the arrangements made with hotels or restaurants. These meals may be offered in the form of a buffet or set menu, depending on the establishment's policies. It's important to note that beverages are generally not included unless explicitly stated otherwise.
While Simplistic Journeys, LLC cannot guarantee specific dietary accommodations, we are committed to making every effort to accommodate special dietary requests. To ensure adequate arrangements, please submit any dietary restrictions or preferences in writing at least 4 weeks prior to departure to info@simplisticjourneys.com . Your satisfaction and comfort are our priority, and we strive to make your dining experience as enjoyable as possible.
TRANSFERS:
Transfers are an integral part of your tour experience, ensuring seamless transportation between various destinations. Depending on the tour, transfers are typically provided by car, minibus, or motor coach, especially if airfare is purchased through Simplistic Journeys, LLC.
It's important to note that if you opt for a land-only tour or deviate from the specified arrival and departure dates, you'll be responsible for arranging your own transfer to the hotel. Our commitment to your convenience includes a guaranteed arrival transfer for up to one hour from your scheduled arrival time, allowing for minor delays. However, beyond this one-hour window, neither Simplistic Journeys, LLC nor the transfer company can be held responsible for flight delays or any other reasons.
In the event of a delay exceeding one hour, whether due to flight issues or other circumstances, it becomes your responsibility to arrange alternative transfer arrangements, such as hiring a taxi. Please be aware that transfer costs are non-refundable, and any additional expenses incurred will be your responsibility.
While the cost of a transfer may be higher than hiring a taxi independently, it's important to understand that our transfer services include round-trip service, also known as 'dead leg.' This means that our drivers must travel to pick you up and may incur entrance and parking fees at airports, seaports, or hotels. Despite not being employed directly by Simplistic Journeys, LLC, our transfer drivers are reliable and provide a full welcome service, ensuring you reach your destination safely and comfortably. However, passengers who are comfortable arranging their own transportation and do not require assistance may opt for taxi or ride share services to save on costs.
SIGHTSEEING & ITINERARIES:
Our sightseeing tours are meticulously planned to provide you with an enriching experience, whether you're traveling solo or with a group. The size of the motor vehicle used for sightseeing is tailored to accommodate the number of participants, ensuring comfort and convenience throughout the journey.
Please note that the times listed in the itineraries are approximate and serve as guidelines, allowing flexibility for unexpected circumstances. Some tours may have early morning start times to optimize daylight hours or to avoid heat in certain climates. It is imperative that you arrive punctually for all scheduled flights, cruises, and activities to avoid being considered a "no-show" and forfeiting the associated services.
While we strive to maintain consistency in service regardless of group size, we cannot guarantee the number of participants on any given tour. Additionally, on dates coinciding with religious holidays or national celebrations, certain sites and monuments may be closed, necessitating adjustments to the itinerary. Similarly, last-minute changes may occur due to unforeseen circumstances such as weather conditions or renovations at tourist sites. However, rest assured that any modifications made will not compromise the quality of your experience.
Our itineraries may include suggestions for leisure activities, but please note that these do not imply endorsement of any specific service provider. The decision to participate in any suggested activities should be made independently and with due consideration.
Tipping:
Tipping guidelines are essential to ensure proper acknowledgment of services provided:
- Tour Manager (Coordinator; may or may not act as a guide): Recommended tip is between US $10-$15 per person per day.
- Driver (Provides chauffeur services and limited assistance with luggage): Suggested tip ranges from US $4-$8 per person per day, or US $4-$6 per half day.
- Local Guide (Offers in-depth information at specific locations): It is customary to tip US $6 per person per day of sightseeing, or US $3 per half day.
Rail Travel:
Rail travel is another aspect of our tours, and once full payment is received, train times are selected, and tickets are issued. It's important to understand that rail tickets are non-refundable and non-changeable once issued unless specific requests are made in writing prior to final payment. Seat assignments are at the discretion of the rail companies, and changes may be subject to local charges and fees. While we endeavor to provide a seamless rail travel experience, passengers are advised to adhere to the specified dates and times on their tickets, as changes may not be possible once the train has departed.
Cruise Itinerary Flexibility:
Cruise schedules and vessels are subject to change without prior notice. In some cases, ships may be chartered, or departure dates canceled, with refunds issued accordingly. Simplistic Journeys, LLC cannot be held responsible for cruise line decisions regarding ship substitutions or itinerary adjustments, including any resulting financial losses such as airline ticket cancellations or visa fees.
Medical Care Provision: While cruise ships have onboard medical facilities, it's important to note that ship doctors may not specialize in all medical fields, and onboard facilities may not meet the standards of land-based hospitals. Simplistic Journeys, LLC and the Carrier do not guarantee the quality of medical care at ports of call or disembarkation locations. Therefore, passengers should be aware of the limitations of ship medical services and consider seeking specialized medical care onshore if needed.
UNANIMITY:
Maintaining a positive group dynamic is crucial for an enjoyable travel experience. Simplistic Journeys, LLC reserves the right to assess individuals and remove disruptive members if necessary. This includes those whose behavior negatively impacts the group. Any resulting expenses, including cancellation fees or alternative travel costs, are the responsibility of the disruptive individual. Unused services are non-refundable, underlining the importance of a respectful and cohesive group atmosphere.
HEALTH REQUIREMENTS:
Prior to travel, consult your healthcare provider for the latest health guidelines. Additionally, visit the Centers for Disease Control (www.cdc.gov ) and/or the World Health Organization (http://www.who.int/en/ ) websites for recommended precautions. If vaccinations are required, ensure they are documented by your healthcare provider on a valid vaccination certificate, which you must carry for verification purposes. Individuals with certain health conditions such as heart disease, chronic illness, physical disabilities, advanced pregnancy, or mental illness are advised against participating in strenuous travel programs. Any traveler displaying symptoms of illness, including fever, will be isolated from the group and directed to a local medical facility for assessment. Only after clearance by a certified medical facility will the individual be permitted to rejoin the group. All expenses associated with medical treatment, additional accommodation, or transportation beyond the original itinerary will be the responsibility of the passenger.
COVID-19 LIABILITY WAIVER:
In the spring of 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a global pandemic. In response, the Center for Disease Control (CDC) issued various preventative measures to mitigate the spread of the virus, including frequent hand washing, wearing masks or face coverings, and maintaining a distance of at least 6 feet from others. Contracting this virus could lead to severe illness for travelers. For further information on COVID-19, please visit the CDC webpage at www.cdc.gov .
By agreeing to the following terms, I acknowledge:
1. COVID-19 is highly contagious and can spread through person-to-person contact.
2. Simplistic Journeys, LLC has provided me with the most up-to-date information available regarding pandemic-protective measures adopted by the vendors and suppliers in my travel itinerary, after reasonable inquiry.
3. Supplier(s) associated with Simplistic Journeys; LLC may have implemented policies to prevent the spread of COVID-19. I understand that Simplistic Journeys, LLC is not responsible for drafting or enforcing these policies, and they are subject to change.
4. I acknowledge that even if suppliers make diligent efforts to enforce protective measures, some travelers may choose not to comply.
5. I am responsible for understanding and adhering to pandemic-protective policies and regulations related to COVID-19 in all states/countries listed in my travel itinerary, including any updates. I understand that failure to comply may result in denial of entry.
6. I acknowledge the possibility of voluntary or involuntary quarantine, either at home or at the travel destination, because of traveling.
7. I am responsible for understanding and complying with pandemic-protective policies and procedures related to COVID-19 implemented by all vendors included in my travel itinerary, including any updates.
8. With full awareness of the risks involved, I, on behalf of myself and my traveling companions, including family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, release Simplistic Journeys, LLC and its officers, agents, independent contractors, affiliates, employees, successors, and assigns ("Released Parties") from any liability, claims, demands, actions, or causes of action, arising directly or indirectly from any loss, damage, injury, or death related to COVID-19, whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with Simplistic Journeys, LLC.
9. I agree to indemnify, defend, and hold harmless the Released Parties from any costs, expenses, damages, claims, lawsuits, judgments, losses, or liabilities, including attorney fees, arising directly or indirectly from any claims related to bodily injury, harm, death, loss of use, monetary loss, or any other injury resulting from my use of Simplistic Journeys, LLC services or services provided by its suppliers or vendors, specifically related to COVID-19.
PASSENGER AGREEMENT:
Passengers must complete a Passenger Agreement before travel, thereby accepting Simplistic Journeys, LLC Terms & Conditions. Online bookings require immediate completion of the Agreement. For telephone bookings, the Agreement will be verbally reviewed and sent via email afterward. Alternatively, it can be provided by fax or mail upon request. Travel documents are released only upon completion of the Agreement. Simplistic Journeys, LLC reserves the right to cancel bookings without it. The Agreement includes Release from Liability, Assumption of Risk, and Binding Arbitration Clauses, which passengers agree to by completing it.
RELEASE FROM LIABILITY:
Simplistic Journeys, LLC, along with its shareholders, directors, officers, employees, and affiliates, does not possess ownership or operational control over any entity providing goods or services for your trip. This includes hotels, airlines, transportation companies, ground operators, excursion organizers, food service providers, and entertainment entities, among others. These entities are all independent contractors. Therefore, Simplistic Journeys, LLC cannot be held liable for any negligent or willful acts or failures to act by these independent contractors or any other third parties. This includes injuries, losses, damages to persons or property, deaths, delays, or inconveniences arising from various circumstances such as acts of God, government actions, force majeure events, acts of war or civil unrest, labor strikes, criminal or terrorist activities, overbooking of accommodations, transportation failures, animal encounters, sanitation issues, food-related illnesses, lack of access to medical care, difficulties in evacuation, epidemics, or any other factors beyond the direct control of Simplistic Journeys, LLC. Additionally, I release Simplistic Journeys, LLC from any negligence on their part and assume all associated risks.
ASSUMPTION OF RISK:
I acknowledge that the travel I am undertaking involves inherent risks, including but not limited to hazards posed by natural forces, wildlife, insects, or plant life, as well as the potential for illness, injury, or death resulting from the negligence of Simplistic Journeys, LLC, or other individuals and entities, whether known or unknown, or from the willful or criminal actions of third parties. I understand that weather conditions may be severe, adverse, or unpleasant, and that medical services or facilities may not be readily accessible during the trip. In order to experience the enjoyment and excitement of this adventure, I willingly accept these risks and uncertainties as integral aspects of my journey. I hereby assume full responsibility for any illness, injury, or death, as well as for any negligence on the part of Simplistic Journeys, LLC, and I agree to release and hold harmless Simplistic Journeys, LLC from any claims arising from third-party negligence.
I acknowledge that I understand the physical requirements of the activities in which I will be participating, and I confirm that I currently do not have any known physical, medical, or mental conditions that would impede my ability to participate safely. I am willing to assume all risks associated with such conditions, whether directly or indirectly related to my participation in this tour. Furthermore, I authorize Simplistic Journeys, LLC, or their local ground handler or representatives, to arrange for any emergency medical treatment and hospitalization that may be necessary for me during this activity, without requiring my further consent.
BINDING ARBITRATION:
I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, either according to the then existing Commercial Rules of the American Arbitration Association (AAA) or pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) Florida law and will take place in Tampa, Florida. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. Please understand that by agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury.
VOLUNTARY PARTICIPATION:
I acknowledge that I have willingly applied to participate in the trip specified on this application (or any trip I may switch to), and that I have thoroughly reviewed the trip description available on the current Simplistic Journeys, LLC website, along with all the details provided in this application. I am participating in this trip voluntarily, fully aware of the potential risks involved.
INFORMED AND VOLUNTARY AGREEMENT:
Having carefully read these Terms and Conditions as well as the booking information sections of this document, I understand their contents entirely. I recognize that this constitutes a waiver of liability and a contractual agreement between myself and Simplistic Journeys, LLC, and I consent to its terms of my own volition. By signing, I affirm my acceptance of these Travel Terms & Conditions and the Simplistic Journeys, LLC Release from Liability, Assumption of Risk, and Binding Arbitration Clause on behalf of myself, each member of my travel party, and any minors under my supervision.
PHOTOGRAPHIC RELEASE:
Simplistic Journeys, LLC reserves the right to capture photographs or videos during its trips, and participants hereby authorize Simplistic Journeys, LLC to utilize these materials for promotional or commercial purposes without any obligation to provide compensation to the participant.
